Website, enquiries, lead forms, bookings and client services

1 Day Marketing (we, us or our) respects your privacy. This policy explains how we manage personal information when you visit our website, respond to an advertisement, submit a Facebook or Instagram lead form, book a meeting, contact us or use our marketing services.

PRIVACY AT A GLANCE• We collect only the information reasonably needed to respond to enquiries, arrange appointments and provide our services.• Meta lead-form details may be transferred to Zoho CRM and used to contact you about the enquiry you submitted.• We do not sell or rent personal information.• You may request access or correction, withdraw marketing consent, or make a privacy complaint at any time.

1. Who we are

1 Day Marketing is an Australian marketing consultancy serving businesses in Ipswich, Greater Brisbane and remotely. Peter Brown is the privacy contact for 1 Day Marketing. Our current contact details appear in section 15.

This policy is intended to reflect the Australian Privacy Principles where they apply to us, together with other applicable Australian laws, including the Spam Act 2003 (Cth). Some small businesses may be exempt from parts of the Privacy Act 1988 (Cth); we nevertheless aim to handle personal information fairly, transparently and securely.

2. What personal information we collect

Depending on how you interact with us, we may collect:

• identity and contact details, such as your name, business name, role, email address, phone number and general location;

• information you provide in an enquiry, Meta Instant Form, website form, email, telephone call, meeting or survey;

• marketing needs, goals, budgets, preferred services and answers provided for a marketing health check;

• appointment information, including the date, time, time zone and booking notes you provide through Calendly or another booking service;

• client and project information, such as proposals, instructions, approvals, deliverables, invoices and payment status (but not full payment-card details where a payment provider processes them);

• communications and records of our interactions with you; and

• technical and usage information, such as IP address, browser and device information, pages visited, referring page, approximate location, campaign source and cookie or analytics identifiers.

We do not intentionally seek sensitive information (for example, health, political, religious or biometric information). Please do not provide it unless it is genuinely necessary and you consent to our handling of it, or the law otherwise permits or requires collection.

3. How we collect personal information

We usually collect personal information directly from you when you:

• visit 1daymarketing.com.au or submit a website contact form;

• submit a lead form attached to a Facebook or Instagram advertisement;

• book a meeting or marketing health check through Calendly;

• email, call, message or meet with us;

• accept a proposal, engage our services or provide feedback; or

• interact with our website, advertising, emails or social media pages.

We may also receive information from referral partners, publicly available business sources, advertising platforms and service providers where it is lawful and reasonable to do so. If we receive information about you from another person, we will use it only for a relevant business purpose and take reasonable steps to ensure you are aware of the collection where required.

4. Why we collect, use and disclose information

We may collect, hold, use and disclose personal information to:

• respond to your enquiry and provide the information, marketing health check or consultation you requested;

• contact you by email, telephone or message and arrange appointments;

• prepare proposals and provide strategy, advertising, content, design, website, email, analytics, training and related services;

• manage leads and client relationships in Zoho CRM;

• administer projects, accounts, billing, records and customer support;

• measure and improve our website, advertising, forms, services and client experience;

• send relevant updates or marketing communications where we have consent or another lawful basis;

• protect our systems, detect misuse, resolve disputes and enforce agreements; and

• meet legal, regulatory, insurance and accounting obligations.

If we cannot collect information reasonably required for an enquiry, booking or service, we may be unable to respond fully, arrange the appointment or provide the requested service.

5. Meta lead forms, Zoho CRM and follow-up

When you submit a Facebook or Instagram lead form, Meta provides the submitted details to 1 Day Marketing. We may transfer those details into Zoho CRM, either automatically through an integration or manually, so we can manage and respond to the enquiry.

Submitting a lead form authorises us to contact you about the offer, service or marketing health check described in that form. This may include an immediate acknowledgement email and a link to book a meeting. It does not automatically mean you have agreed to unrelated or indefinite promotional marketing.

Meta and Zoho separately control how they handle information within their own services. Their privacy terms also apply when you use those platforms.

6. Bookings through Calendly

If you use a Calendly link, Calendly may collect your contact details, scheduling preferences, time zone and any answers you provide. We use that information to arrange and manage the appointment. Calendar, video-conferencing and reminder providers may also receive the minimum information needed to deliver the booking. Calendly’s own privacy policy applies to its processing.

7. Direct marketing and your choices

We may send service-related messages that respond to an enquiry, confirm a booking or relate to work you have requested. We send promotional electronic messages only where we have your express consent, where consent may lawfully be inferred, or where another legal basis applies.

Promotional emails will identify 1 Day Marketing, include current contact details and provide a clear way to unsubscribe. You can unsubscribe through the link in the message or contact us directly. We will action a valid unsubscribe request within five working days. Withdrawing marketing consent will not stop necessary service or transaction messages.

8. Cookies, analytics and advertising technologies

Our website may use cookies and similar technologies to make the site work, remember preferences, understand traffic and measure advertising. Where enabled, tools may include website analytics and advertising technologies such as Google Analytics or the Meta Pixel.

These tools may collect technical, device and interaction data and may connect it with information held by the relevant provider. You can adjust cookie controls in your browser and, where available, in our website controls. Blocking cookies may affect some site functions. You can also manage advertising preferences through the relevant platform.

9. Who we disclose information to

We may disclose personal information, where reasonably necessary, to:

• technology providers that support our website, email, file storage, CRM, scheduling, analytics, advertising and communications, including Meta, Zoho and Calendly;

• contractors and specialist service providers who assist us to deliver agreed work and who need the information for that purpose;

• professional advisers such as accountants, insurers, IT support and legal advisers;

• a purchaser or adviser involved in a proposed sale, restructure or transfer of our business, subject to appropriate confidentiality protections; and

• regulators, courts, law-enforcement agencies or other parties where required or authorised by law, or where reasonably necessary to protect rights, safety or security.

We do not sell or rent personal information. We ask service providers to handle information only for the services they provide, subject to their contracts and applicable law.

10. Overseas processing and disclosure

Some technology providers operate globally or use overseas infrastructure, support teams or subprocessors. As a result, personal information may be processed in, accessible from or disclosed to recipients outside Australia. Likely locations include the United States, and other countries identified in the current hosting and subprocessor information of Meta, Zoho, Calendly and our other providers.

Provider locations can change. Where Australian privacy law applies, we take reasonable steps appropriate to the circumstances to use reputable providers and protect personal information in connection with an overseas disclosure.

11. Security, retention and data breaches

We take reasonable administrative, technical and physical steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These steps may include access controls, account security, reputable hosted systems, backups and limiting access to people who need it. No internet transmission or storage system can be guaranteed to be completely secure.

We retain personal information only for as long as reasonably needed for the purposes described in this policy, to maintain appropriate business records, resolve disputes and meet legal or accounting obligations. When information is no longer required, we take reasonable steps to delete or de-identify it. Where applicable, we assess and respond to eligible data breaches under the Notifiable Data Breaches scheme.

12. Access, correction and deletion requests

You may ask to access personal information we hold about you or request that inaccurate, incomplete or out-of-date information be corrected. You may also ask us to delete information, although legal, accounting, dispute-resolution or operational requirements may mean we need to retain some records.

Please contact us using section 15. To protect privacy, we may ask for reasonable proof of identity. We will respond within a reasonable period and explain any lawful reason why a request cannot be completed in full. We do not charge for making a request, although a reasonable access cost may apply where permitted by law and advised in advance.

13. Privacy complaints

If you have a privacy concern, please contact us with enough detail for us to investigate. We will acknowledge and assess the complaint, may ask for further information, and aim to provide a response within 30 days. If we need more time, we will let you know.

If you are not satisfied with our response and the Privacy Act applies, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au. The OAIC generally expects you to first give the organisation a reasonable opportunity to respond.

14. Other matters

Third-party links. Our website, emails and advertisements may link to third-party websites or platforms. We are not responsible for their privacy practices, and you should review their policies before providing information.

Children. Our services are directed to businesses and adults. We do not knowingly solicit personal information from children under 18. If you believe a child has provided information without appropriate consent, please contact us.

Automated decisions. We do not currently use personal information in computer programs to make decisions solely by automated means that could reasonably be expected to significantly affect a person’s rights or interests. We will update this policy if that changes.

Changes to this policy. We may update this policy when our practices, providers or legal obligations change. The current version will be published on our website with its updated date. Material changes will be highlighted where appropriate.
